When is an assignment genuinely self-employed work?

Self-employed and freelance work runs through Servorg, using a checklist we put to the client. Servorg decides whether the assignment really is self-employed or freelance work; if it does not pass, we do not offer it as such.

How it works with us

Stricter with the client than with the professional

Our requirements for the self-employed professional are strict, and stricter still for the client. That sounds the wrong way around, and it is meant to be: most of the risk around bogus self-employment comes from how the assignment itself is set up: who directs the work, and whether it can be defined as a distinct piece of work. That is where the ground is won, so that is where we set the bar highest. The aim is to keep the risk of bogus self-employment as small as possible for everyone involved. And there is a second, more concrete reason: if it goes wrong, the bill lands with the client. That is why the bar is highest there.

And if it does go wrong: who gets the bill?

If it does go wrong and the tax authority rules that the work was bogus self-employment, Servorg recovers the additional assessment and the fines from the client. That is what the terms say, and we would rather tell you beforehand than afterwards. It is exactly why we assess up front rather than after the fact: nobody wants that bill, and the only way to avoid it is to set the assignment up properly before anyone starts.

And if the assignment does not pass?

The bar is concrete. A self-employed assignment runs with us for a maximum of twenty-eight hours a week, and Servorg tests whether you are genuinely independent: can you decide how you do the work, and can you make your own decisions? If you sit in one chair forty hours a week inside a team that directs you, that is not a self-employed assignment: whatever the contract is called. By the time an assignment goes live with us as a self-employed assignment, that check has usually already been done. That is the intention and it nearly always works. If it cannot be arranged beforehand and the assignment then fails the check, we offer you the same assignment where possible as a secondment under one of our other brands. If that does not work either, we say so.

The Wtta and admission

The Dutch Wtta act sets requirements for anyone who supplies labour. In our case that part sits with Servorg, together with employership, payroll and invoicing. For you that means one party that has to meet those requirements, and no intermediate link on our side. What applies from when is set out below.

This is a timeline, not a law that already applies today. No labour provider has been admitted yet, our partner Servorg included, and we claim nothing of the sort. The assessment is about the assignment, not about you as a person. Servorg uses a checklist to judge whether the work can be carried out as self-employed or freelance work, and we put that checklist to the client as well.

What happens if the assignment does not pass?

Then we do not offer it as self-employed work, but as a secondment through another of our brands. The assignment itself does not disappear.

Who is my client?

The organisation where you do the work. Employership, payroll and invoicing run through Servorg; we find and support.

Do you work with a model agreement?
